"Gen. Kayani to be made Supreme Commander" - Writ petition filed in Lahore High Court


A writ petition was filed in the Lahore High Court on Saturday, seeking directions to the federal government to transfer the powers of the Supreme Commander of the Armed Forces to the Chief of Army Staff.


The petition, filed by Tehreek-E-Inqilab Pakistan chairman Rana Illumuddin Gazi advocate, stated the Pakistan army could not take prompt action to stop USZ attack in Abbotabad on May 2 because powers to make decisions for any such action vested with President Asif Ali Zardari, not with the chief of army staff General Ashfaq Parvez Kayani. The petitioner made the Federation, the President of Pakistan, the ministries of foreign affairs, defence and interior respondents in the case. The petitioner said the defence of borders of the country would not be foolproof until it was in the hands of the army, with all powers consolidated in the chief of chief staff for prompts action, in case any attack on the territorial borders of Pakistan. He argued that Field Martial General Ayub Khan in 1965 was the Supreme Commander of the armed forces of the country when India imposed war on Pakistan, and he, taking timely decision, launched counterattack and frustrated the evil designs of the enemy.

He said that President Asif Ali Zardari was the supreme commander of the armed forces now and the Army was not fully authorized to take decisions regarding defence of the country. He said any delay in the decision-making by the President could harm the solidarity and defence of the borders; and the blame for failure to take timely action would fall on the army, not on the President in case any such attack comes from either USZA or India. He prayed to the court to accept the petition for regular hearing and pass direction to the Federation and the President of Pakistan to transfer the powers of the Supreme Commander of the armed forces to the chief of army staff immediately in the greater national interest. USZ ambassador persona non grata: A writ petition was filed in the Lahore High Court on Saturday, seeking directions to the federal government to declare the USZ ambassador to Pakistan persona non grata, recall the Pakistani ambassador to America, Hussain Haqqani, and stop transit facilities to the USZ until it seeks public apology on the Abbottabad operation.

The court was also requested to ask the government to refer the matter to the International Court of Justice (ICJ). Barrister Javed Iqbal Jaffrey filed the petition and submitted that the USZ was bound to accept the jurisdiction of the International Court of Justice under a treaty of friendship agreed in 1959.

  1. How come an Army of Lions taking orders from Hyenas....

    It should not be big deal for lions to sweep away the hyenas. lets see when they do that but i hope it wouldn't be another pervez musharraf but a caretaker gov. we are waiting for the bold step.
